Prenuptial Agreements

A Prenuptial Agreement is a written agreement made by a couple who intend to get married and who wish to specify what would happen to the matrimonial assets in the event of a divorce.

 

At present Prenuptial Agreements are not enforceable by the Courts but in some cases the terms of the agreement will be considered by a Judge as an indication of the parties' financial intentions. It is extremely important that a Prenuptial Agreement is drafted correctly in order to ensure that it will be taken into account by the Court should there be a disputes in the future.
